You agree that

1. Accuracy of Statements – All information displayed in artist profiles, analytics, and communications is provided in good faith.

2. No Defamation – Users may not post, publish, or communicate false, misleading, or harmful statements about [Your Label Name], its partners, or other users.

3. Legal Recourse – Any defamatory, harmful, or malicious statements may result in legal action, including claims for damages.

4. User Responsibility – You are responsible for the content you submit, share, or publish regarding our label, staff, or other artists.

These Terms of Use are entered into by and between Messiahsoy Records, doing business as Audio Track Masters (“Company”, “Label”, “Service”, “We”, “Us”), and the individual or entity using the services (“Artist”, “User”, “You”).

By creating an account, uploading content, or using the services provided by Messiahsoy Records / Audio Track Masters, you agree to be bound by these Terms.

1. OVERVIEW OF SERVICES

Messiahsoy Records / Audio Track Masters provides digital music services, including but not limited to:

• music distribution
• artist account management
• catalog management
• analytics reporting
• promotional tools
• content hosting
• optional label services

These services allow artists and rights holders to upload music and distribute recordings to digital music platforms worldwide.

1. THIRD-PARTY DISTRIBUTION

​

Messiahsoy Records / Audio Track Masters utilizes third-party distribution partners to deliver content to digital music services.

These services may include but are not limited to:

• streaming platforms
• digital stores
• digital radio services
• music discovery platforms
• content identification systems

By uploading content, you acknowledge and agree that your content may be delivered to these platforms through third-party distributors.

All third-party platform policies, processing times, and reporting schedules apply.

Messiahsoy Records does not control the internal policies or operations of digital music services.

1. OWNERSHIP OF CONTENT

​​

Artists retain ownership of their music and intellectual property.

By submitting content, the artist confirms that they:

• own the rights to the recordings and compositions
• have permission from all collaborators and contributors
• have the authority to distribute the content

Artists grant Messiahsoy Records a license to distribute, promote, store, and transmit the content through digital platforms worldwide.

This license remains active for as long as the content remains distributed through the service.

1. REVENUE COLLECTION

​​

Revenue generated from distributed music is collected through third-party distribution networks and digital music services.

Messiahsoy Records receives revenue related to the exploitation of the content and allocates earnings to the artist account associated with the release.

All revenue displayed within the platform dashboard should be considered provisional until cleared by distribution partners and digital music services.

1. PAYMENT PROCESSING

​​

Artists may request payment from their available balance through the payment methods supported on the platform.

Payments may be processed through external financial services including digital payment providers or banking networks.

Processing times may vary depending on payment provider policies, compliance reviews, or distribution reporting schedules.

Taxes, processing costs, and other applicable charges may be deducted where required by law or by third-party processors.

1. FRAUD PREVENTION

Messiahsoy Records maintains a strict anti-fraud policy.

Artists may not:

• generate artificial streams
• use bots or automated streaming tools
• participate in streaming manipulation schemes
• engage in deceptive promotional tactics

If fraudulent activity is detected, the label reserves the right to:

• remove content
• suspend accounts
• withhold revenue
• terminate service access

1. CONTENT GUIDELINES

Artists may not upload content that:

• infringes copyright
• contains unlawful material
• promotes hate or violence
• violates the rights of third parties
• contains misleading or fraudulent information

Messiahsoy Records reserves the right to remove content that violates these guidelines.

1. PROMOTIONAL USE

​

Artists grant Messiahsoy Records permission to use:

• artist name
• artwork
• music excerpts
• promotional media

for marketing and promotional purposes related to the platform and services.

1. ACCOUNT RESPONSIBILITY

​​

Artists are responsible for maintaining the security of their account credentials.

Any activity occurring under an account will be considered authorized by the account holder.

Users must immediately notify the company if unauthorized activity is detected.

1. SERVICE PLANS AND TIERS

​​

Messiahsoy Records may offer multiple service tiers that provide access to various tools, features, and distribution capabilities.

Service plans may include:

Free Plan
Starter Plan
Pro Plan
Elite Plan

Each tier may include different levels of access to platform features, artist tools, and support services.

Details regarding features and access levels will be provided within the platform interface.

1. SERVICE DISCLAIMER & LIABILITY

By using Audio Track Masters ("the Service"), you acknowledge and agree that the Service, its owners, operators, affiliates, partners, and employees shall NOT be held responsible, liable, or accountable for:

• Third-Party Lawsuits: Any legal actions, claims, disputes, or proceedings brought by third parties, including but not limited to copyright holders, labels, publishers, distributors, or any other entity.

• Loss of Service: Any interruption, suspension, or termination of distribution services, including but not limited to platform outages, account suspensions, or changes in third-party service availability.

• Royalty Disputes: Any loss, delay, reduction, or non-payment of royalties arising from platform policies, accounting discrepancies, or disputes with distribution partners.

• Content Takedowns: Any removal, restriction, or blocking of content by streaming platforms, distribution partners, or as a result of copyright claims, DMCA notices, or content ID matches.

• Revenue Loss: Any financial losses, lost earnings, or damages resulting from the use or inability to use the Service.

1. LEGAL COUNSEL ACKNOWLEDGMENT

By accepting these terms, you expressly acknowledge and agree that:

• You have been advised and encouraged to seek independent legal counsel before subscribing to or using the Service.

• You may choose to obtain legal advice or decline to do so at your own discretion and risk.

• Your decision to use the Service without obtaining independent legal counsel is made voluntarily and with full understanding of the risks involved.

• The Service does NOT provide legal advice, representation, or any form of legal services.

1. INTELLECTUAL PROPERTY & RIGHTS

You represent and warrant that you own or have the proper licenses for all content submitted through the Service.

You are solely responsible for ensuring your content does not infringe on any third-party rights, including copyrights, trademarks, or other intellectual property rights.

Any content found to violate intellectual property laws may be removed without notice, and your account may be suspended or terminated.

1. COMMISSION & ROYALTY STRUCTURE

​

Free Plan: The Service retains 15% of all royalties earned through distribution.

Starter Plan ($24.99/yearly: The Service retains 5% of all royalties earned.

Pro Plan ($49.99/yearly): 0% commission — you keep 100% of royalties.

Elite Plan ($99.99/yearly): 0% commission — you keep 100% of royalties plus premium services.

Non-subscribed accounts that discontinue their paid subscriptions will earn 85% of royalties (15% commission) while releases remain active in stores

1. INDEMNIFICATION

​​

You agree to indemnify, defend, and hold harmless the Service and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• your use of the Service
• your uploaded content
• violation of intellectual property rights
• breach of these Terms

1. LIMITATION OF LIABILITY

​​

IN NO EVENT SHALL THE SERVICE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

THE TOTAL LIABILITY OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

1. DISPUTE RESOLUTION

​

Any disputes arising from these terms or the use of the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules.

You waive your right to participate in class-action lawsuits or class-wide arbitration.

Both parties agree to attempt good-faith negotiation before initiating arbitration proceedings.

1. TERMINATION

Either party may terminate use of the services at any time.

Upon termination:

• distribution may be discontinued
• content may be removed from digital platforms
• outstanding balances may be reviewed before final payout

Certain rights related to previously distributed content may remain active until takedown processes are completed.

1. GOVERNING LAW

​

These Terms shall be governed by applicable laws within the United States.

Any disputes arising from these Terms shall be resolved within the appropriate legal jurisdiction.

1. MODIFICATIONS TO TERMS

​​

The Service reserves the right to modify these terms at any time.

Users may be notified of material changes through email or platform notifications.

Continued use of the Service after modification constitutes acceptance of the updated Terms.
